Please read the terms and conditions displayed before using the seafolly.com website. By using the seafolly.com website, your are deemed to have read the terms and conditions and be bound by them.
This website has been developed for use by customers and intended customers. You agree not to use the website in any way that causes or is intended to cause access or the website to be damaged, interrupted, or impaired in anyway including but not limited to:
- Causing annoyance or nuisance inconvenience or mischief
- Fraudulent purposes or in connection with unlawful or criminal activity
- Breach of copyright, trademarks, confidence, privacy or any other right

When you place an order to purchase a product from Seafolly, we will send you an email confirming receipt and details of your order. Our acceptance of this offer to purchase will be at the time we dispatch that product to you and a confirming email in this regard is sent. The acceptance will be complete at this time. It is agreed at the time you place an order it is your intention to enter into a contract with Seafolly Pty Limited.
Pricing and availability
All pricing is in Australian dollars.
Seafolly list products for sale on its website as indicated. Whilst we use our best endeavors to fulfill such orders, we cannot be held responsible if the products are not available at a given point in time. It is further noted that dispatch times indicated below are a guide and are not guaranteed dispatch times and should not be relied upon as such.
When ordering goods from Seafolly.com for delivery to any destination outside Australia, the recipient may be charged import duty and other taxes including but not limited to sales tax which are levied on import values above a threshold by the customs authority in that overseas country. It is the responsibility of the purchaser to pay these amounts to the freight company if applicable prior to delivery. It is outside our area of control and responsibility to determine, advise or influence these charges.
As customs policies vary drastically from country to country, you are requested to direct queries of this nature to your local customs office. Customers should also note that the recipient is to be regarded as the Importer of record and you will need to comply with whatever regulations are required in this regard in the country of the recipient. Seafolly are neither able to advise on process to claim back , nor refund, any duty and taxes paid should an ordered item be returned.
Seafolly.com assumes all sales are made to persons over the age of 18. If you are under 18, you need to have the involvement of a parent or guardian.
Payment is only accepted by means of the credit card types as shown and Paypal. We are unable to process any other payment form.
Alterations to terms and conditions
We reserve the right to make changes to our website, policies, terms and conditions at any time.
Should you breach any terms or conditions, and we take no action against you, we shall be entitled to invoke our rights and remedies in any other situation where you breach these conditions.
The above terms and conditions are governed by the laws applicable of the state of New South Wales in Australia. Both parties submit to the non exclusive jurisdiction of the New South Wales Courts.
Delivery is available to Australia only. We will ship your order within 5 business days, subject to payment authorization and stock availability.
All goods will be delivered by Australian Air Express (AAE) and is free of charge.
All orders require a signature upon receipt.
No delivery will therefore be permitted to a Postal Box or similar address.
We are unable to redirect orders once items have been dispatched.
Order cut-off times are provided as guidelines only, and do not take into account possible delays caused by payment authorization.
We cannot beheld liable for any delay in delivery and the above time is as provided to us by the Freight company.
If you are not completely happy with an item, we will exchange it or give you a refund, provided that it’s returned to us in its original condition and packaging, unworn, unwashed, and with all labels intact. Please include a copy of your original invoice as we will require this to process the refund. Requested exchange items are subject to availability.
Please make sure that swimwear is tried on over your own underwear. In the interests of hygiene, we may refuse returns of items where it’s obvious that this hasn’t been done.
Returns and exchanges are accepted on merchandise within 31 days of receipt.
PLEASE NOTE: Shipping and handling charges are non-refundable. If you return a product on which duty and tax has been paid, Seafolly are unable to refund such duty or taxes.

Simply securely pack and seal the return merchandise and invoice in an appropriate shipping box or envelope, and send back to us using a trackable service to the above address. (This will provide you with recourse on your package, as we cannot accept responsibility for packages that we do not ship ourselves).
Once your package has been received, your refund will be processed in the original form of payment within seven business days. You will be notified via email to the address listed on your account when this transaction has taken place. Please note that your banking institution may require additional days to process and post this transaction to your account once they have received the information from Seafolly.
Original payment by credit card – if you’ve requested replacements of a higher or lower value, any difference due will be charged or refunded to the card used to pay for the original order. We will do the first exchange with no postage charge when returning the new garment. After the first exchange, postage for any additional exchanges will be charged as per our listed rates.
Original payment via Paypal – if you’ve requested replacements of a higher or lower value, we will process a full refund and you will need to place a new order for the replacement item. Payment adjustments can not be made via Paypal. If you have requested a replacement of the exact same value, we will process the exchange and mail you the replacement, subject to stock availability.
All replacement items are sent using Australian Air Express. We will email a tracking number once the goods have been dispatched
Cardholder account data
Seafolly does not store any cardholder data, all credit card payment service are secure and are handled by SecurePay.
SECURE PAY SECURITY STANDARDS
The focus of our security is centred around the safe processing and storage of sensitive personal Credit Card, Charge Card and Direct Entry information. PCI DSS (Payment Card Industry Data Security Standard) Compliance is a strict security standard the card schemes (Visa and MasterCard) have introduced globally to ensure personal information is properly protected. SecurePay holds the highest level of PCIDSS accreditation.
SecurePay’s Operations Network is audited on an ongoing basis by external auditors, namely Vectra Corporation, for the purpose of certifying compliance with PCI DSS.
Ongoing network scans, a requirement of PCI DSS, are completely regularly and are performed by McAfee Secure.
